Merge Intellectual and Business, Investment, Environmental law and litigation Committee

Term of Reference

  • To evaluate the role of the IPC viz a viz objectives of the Association;
  • To harmonise the aims of the IPC with those of LAZ as established;
  • To identify gaps and areas where the IPC would provide its skills and proficiencies by:

    • Educating Advocates on IP

    • Educating the members of the public on the importance of IP through seminars, workshops, the media (TV, radio and newspapers) and giving talks/lectures

  • To contribute and make recommendations by way of comments on IP legislation expertise;
  • To establish contact with foreign institutions/bodies (e.g. law firms in South Africa, WIPO) and gain from their experience;
  • To establish a library specialising on IP publications and material in conjunction with the Patents and Trade Marks Registration Agency (PACRA) for use by LAZ members and IP agents.
  • Scrutinize various investment opportunities with the ultimate desire of growing the assets of the Association;
  • Look into and submit recommendations for the creation of a Fund;
  • Set investment guidelines and portfolio thresholds;
  • With the approval of council, engage Fund Managers as appropriate; and
  • Take all steps necessary and/or incidental to the foregoing for the operation of the Fund, if created;
  • To review and monitor the environmental policies and activities on behalf of the Council.
  • To keep the membership informed on the lasted development in environment law, policies and best practices.
  • To report regularly and on a timely basis to the Council on matters coming before the Committee relating to environmental policies and activities for consideration and the manner of disposition.
  • To spear-head litigation on the part of LAZ;
  • To prosecute and defend all matters in which LAZ is interested;
  • To act as the conduit for the distribution of all litigation matters among its members; and to the Association’s general membership if necessary;
  • To develop the law through litigation by way of applications for interpretation of statutes;
  • To identify and recommend to the Council matters which LAZ might be interested in for the purposes as acting as amicus curia; and
  • To attend to all matter’s incidental to its stated terms of reference or as lawfully directed to the Committee by Council.
